Slip and Fall Accidents In Retail Stores Occur in a Variety of Ways

Loose rugs, wet floors, debris, uncleared sidewalks – These conditions and more can cause a retail customer to slip, trip, or fall and seriously injure themselves. While you may not consider your safety when you are shopping, store owners must.

They have multiple legal obligations to satisfy.

What Do Retail Store Owners Need to Do Fulfil Their Legal Obligations to Customers?

Retail store owners must take reasonable care to keep the premises safe for the public. Failure to satisfy this duty is called negligence. If someone gets injured because of the negligence, legal liability results.

Holding a store liable for injuries after an accident on the premises requires proof of negligence. For example, if you slip, trip, and fall in TJ Maxx, you must prove that the store either failed to do something it should have or did something to cause your accident and injuries. Usually, the court considers, among other things, if the retailer knew or should have known about the dangerous condition that caused the accident.

Retail Stores Pay Victims of Slip and Fall Accidents

Let’s look at some real-life slip and fall lawsuits that resulted from accidents in retail stores:

  • In Texas, a woman tripped over a “loose rug” in Marshalls. She has sued TJ Maxx doing business as Marshalls for between $200,000 and $1,000,000 for her injuries. Her complaint alleged that Marshalls failed to maintain the store in a reasonably safe manner.
  • A woman in North Carolina sued Walmart after slipping on loose blueberries. She allegedly fell backward, causing “unbearable pain” to her back. Her lawsuit asked for at least $75,000 in damages.
  • A Pennsylvania woman sued TJ Maxx when she stepped in a puddle and fell in the store. She alleged that her fall left her permanently disabled. Her complaint also alleged that TJ Maxx failed to address the hazard on the floor promptly and failed to warn people of the danger of the puddle.
